Last updated: 23 September 2026

1. Introduction and Purpose

This Acceptable Use Policy applies to all Users and prospective Users of the Platforms operated through folioandpin.com and colophonrow.com. It sets out the rules governing acceptable use of the Platforms, Project functionality, Project Materials and Services made available through them.

This Policy forms part of the contractual terms governing use of the Platforms and should be read together with the Terms & Conditions. Personal data processed in connection with Platform use is handled as described in the Privacy Policy.

The Platforms are operated by PINK CIRCLE LIMITED, company number 15647366, as online marketplaces through which Users may discover and interact with Independent Service Performers offering visual marketing Services. PINK CIRCLE LIMITED provides and administers the marketplace infrastructure but does not itself provide the underlying visual marketing Services.

Independent Service Performers provide Services independently and on their own behalf. Nothing in this Policy creates an employment, worker, agency, partnership or joint venture relationship between PINK CIRCLE LIMITED and any Independent Service Performer.

The purpose of this Policy is to promote lawful, responsible and good-faith use of the Platforms and to reduce risks arising from unlawful content, fraud, intellectual property infringement, misuse of personal data, deceptive activity, security threats or other prohibited conduct.

The Company may apply proportionate technical, operational, moderation and compliance measures where reasonably necessary to assess or address suspected breaches of this Policy, the Terms & Conditions or applicable law.

2. Definitions

For the purposes of this Acceptable Use Policy:

Company means PINK CIRCLE LIMITED, company number 15647366, acting as the operator of the Platforms.

Platform means the relevant online marketplace operated by the Company through folioandpin.com or colophonrow.com, as applicable.

User means an individual who accesses or uses a Platform, creates an account, submits or participates in a Project, uploads Project Materials, purchases Services or otherwise interacts with the Platform. A User may act personally or as an authorised representative of a business or organisation. A legal entity does not itself become an account holder.

Services means visual marketing services offered and performed independently by Independent Service Performers through the Platforms, including Services within the categories of Logos & Branding, Typography & Icons, Illustrations & Graphics, Infographics & Data and Web & Social Media.

Independent Service Performer means an independent third-party professional who offers and performs Services through a Platform on their own behalf and is not an employee, worker, agent, partner or authorised representative of the Company.

Project means an engagement or proposed engagement between a User and an Independent Service Performer relating to Services requested or offered through a Platform.

Project Materials means documents, text, images, instructions, specifications, brand materials, design assets, video files used solely as supporting or reference material, and other information submitted or exchanged in connection with a Project.

Prohibited Activities means conduct, content, Project requests, Project Materials or use of a Platform that is prohibited under this Policy.

Applicable Laws means laws, regulations and legally binding requirements applicable to the relevant User, Project, Service, Project Materials, intended use or Platform activity, including laws applicable in England and Wales where relevant.

Capitalised terms not defined in this Policy have the meanings given to them in the Terms & Conditions.

3. Acceptable Use

The Platforms may be used only for lawful, legitimate and good-faith purposes consistent with their intended operation as visual marketing marketplaces.

Users may request Services within the categories of Logos & Branding, Typography & Icons, Illustrations & Graphics, Infographics & Data and Web & Social Media, provided that the Project, Project Materials and intended use of any Deliverables comply with this Policy, the Terms & Conditions and Applicable Laws.

Users may submit Project briefs, instructions, text, images, brand assets, design materials and other information reasonably necessary for a Project. Video files may be submitted only where relevant as supporting or reference material. Video production and video editing are not Services or final Deliverables offered through the Platforms.

Users are responsible for ensuring that Project Materials are accurate, lawful and provided with all rights, licences, permissions or other authority necessary for their use. Project Materials must not infringe intellectual property rights, privacy rights, confidentiality obligations, contractual rights or other rights of third parties.

Where Project Materials contain personal data relating to another individual, the User is responsible for ensuring that there is an appropriate lawful basis or other authority to provide that information for the relevant purpose.

Subject to the rights granted under the Terms & Conditions, full payment of applicable fees and any applicable Project-specific terms, final Deliverables may be used for lawful commercial, promotional, editorial, educational or internal business purposes. Users must not use Deliverables to falsely imply governmental approval, certification, affiliation, endorsement or other official status that does not exist.

Users must use Platform functionality only for its intended purposes, including account management, Project requests, Project-related communications, file exchange, payment-related processes, revisions and access to Deliverables. Information submitted through the Platform must be accurate and provided in good faith.

The Company may assess whether Platform activity or a requested Project appears consistent with this Policy, the Terms & Conditions and Applicable Laws. Such assessment does not constitute a guarantee that Project Materials, Services or Deliverables are lawful or suitable for any particular use.

Where the Company reasonably identifies a breach or material risk, it may restrict relevant Platform functionality, prevent or cancel pending Platform activity where appropriate, suspend or terminate access, or take other proportionate measures permitted by the Terms & Conditions and Applicable Laws.

4. Prohibited Technical and Behavioural Use

Users must not access or use a Platform in a manner that disrupts, interferes with or materially affects its security, integrity, availability or proper operation.

Unauthorised automated access is prohibited. This includes the use of bots, scripts, crawlers, scrapers, artificial traffic-generation tools or similar automated technologies except where expressly authorised by the Company.

Users must not bypass, disable, interfere with or attempt to circumvent authentication procedures, access controls, rate limits, payment-related controls, security measures or other technical safeguards.

Users must not attempt to gain unauthorised access to another User's account, Project information, Project Materials, internal systems, databases or supporting infrastructure.

The Platforms must not be used to upload, transmit or introduce malware, viruses, malicious code, corrupted files, concealed scripts or other harmful components intended or capable of damaging, manipulating or disrupting systems, services or devices.

Users must not misuse account registration, Project submission, file uploads, communications, payment-related functionality, revision processes, support channels or other Platform features. This includes creating false or artificial Project requests, deliberately generating abnormal system activity, abusing revision or complaint procedures, or using Platform functionality for fraudulent or unauthorised purposes.

Phishing, credential harvesting, impersonation, spam, unauthorised data extraction, unlawful scraping, deceptive account activity and other conduct intended to obtain data or access without authority are prohibited.

Users must not use the Platforms in connection with fraud, money laundering, sanctions evasion, deceptive commercial practices, falsified identities or documents, unlawful intellectual property infringement, or other activity prohibited by Applicable Laws.

Where reasonably necessary to enforce this Policy, protect Platform security or investigate suspected misuse, the Company may review information and activity available through the Platforms, request additional information, restrict functionality or access, preserve relevant records and cooperate with competent authorities or relevant third-party service providers where required or permitted by law.

5. Purpose Limitation and Responsible Content Use

The Platforms and Services made available through them may be used only for lawful commercial, promotional, editorial, educational, internal business and other legitimate purposes consistent with the intended operation of the Platforms as visual marketing marketplaces.

Users are responsible for Project instructions, claims, text, images, trademarks, logos, brand materials, references and other Project Materials they submit. Users must ensure that such materials are accurate where factual accuracy is relevant, lawfully provided and supported by all rights, licences, permissions or other authority necessary for their use.

The Company does not independently verify the factual accuracy, regulatory status, advertising claims, licensing status or legal validity of User-submitted Project Materials unless a specific verification step is expressly required as part of an applicable Platform process. Independent Service Performers may rely on information and instructions supplied by Users when performing agreed Services.

The Platforms must not be used to request, create, facilitate, distribute or promote visual materials that are materially false, deceptive, misleading or intended to misrepresent facts, identities, products, services, endorsements, affiliations or official status.

Users remain responsible for ensuring that Project Materials and the intended use of Deliverables comply with Applicable Laws, including applicable advertising, consumer protection, intellectual property, privacy and data protection requirements.

Where the Company reasonably determines that a Project request, Project Materials or intended use is inconsistent with this Policy, the Terms & Conditions or Applicable Laws, it may restrict the relevant Platform activity, request clarification or additional information, or prevent the Project from proceeding through the Platform.

6. Prohibited Activities

The Platforms must not be used for unlawful, fraudulent, deceptive, exploitative, abusive or otherwise prohibited purposes.

Users must not use a Platform or request Services in connection with the promotion, sale or distribution of controlled substances, pharmaceuticals, weapons, explosives or other regulated products or services where such activity is unlawful, prohibited or restricted under Applicable Laws.

The Platforms must not be used in connection with human trafficking, forced labour, sexual exploitation, child exploitation or other forms of unlawful human exploitation.

Users must not use the Platforms for fraud, phishing, impersonation, identity misuse, falsified documents, deceptive financial activity, unlawful investment schemes, counterfeit goods, intellectual property infringement, software piracy, sanctions evasion or other unlawful or deceptive commercial activity.

Users must not request or use Services to create, facilitate or promote unlawful hate speech, unlawful discrimination, harassment, threats, violence, terrorism, extremist activity or other unlawful harmful conduct.

The Platforms must not be used for child sexual exploitation or abuse material, non-consensual intimate material, unlawful explicit material or other sexually exploitative or abusive content.

Users must not use a Platform where doing so, or where the relevant Project or transaction, would violate applicable sanctions, trade restrictions, export controls or other legally binding restrictions.

The Company may also restrict a Project where there are reasonable grounds to believe that the requested Service, Project Materials or intended use would materially facilitate unlawful, fraudulent, deceptive, exploitative or abusive activity.

A breach of this section may result in restriction or suspension of Platform functionality, cancellation or prevention of pending Platform activity, termination of access or other proportionate measures permitted under the Terms & Conditions and Applicable Laws.

7. Assessment of Service Eligibility

The Company may apply proportionate, risk-based assessment measures where reasonably necessary to determine whether a requested Project, the proposed use of the Platform or the intended use of Deliverables appears consistent with this Acceptable Use Policy, the Terms & Conditions and Applicable Laws.

Such assessments are not necessarily carried out for every User or Project and do not constitute continuous monitoring of Users, Independent Service Performers or Project activity.

Where reasonably necessary, the Company may request additional information concerning the nature of the Project, the intended use of the requested Services, the User's authority to provide relevant Project Materials or other matters directly relevant to compliance with this Policy. Any personal data processed in connection with such assessment will be handled in accordance with the Privacy Policy.

Any assessment under this section is carried out solely for Platform access, contractual, compliance, security and risk-management purposes. It does not constitute legal advice, regulatory approval, certification, endorsement or verification of a User, Independent Service Performer, business activity, Project or Deliverable.

The Company does not guarantee that a Project, Project Material or intended use is lawful merely because it has not been restricted under this Policy. Users and Independent Service Performers remain responsible for their respective obligations under Applicable Laws and the applicable Platform terms.

Where information provided for an assessment is materially incomplete, inconsistent, inaccurate or misleading, or where reasonable concerns remain unresolved, the Company may request clarification, restrict the relevant Platform functionality, prevent a Project from proceeding or take other proportionate measures permitted by the Terms & Conditions.

8. Company Rights and Enforcement

Where the Company reasonably identifies a suspected or actual breach of this Policy, the Terms & Conditions or Applicable Laws, it may take proportionate action to protect the Platforms, Users, Independent Service Performers, service providers and other relevant parties.

Depending on the circumstances, such action may include requesting additional information, limiting particular Platform functionality, preventing or cancelling pending Platform activity, temporarily suspending access, terminating an account or restricting future use of the Platforms.

The Company may take action where relevant concerns arise after an account has been created or after a Project has begun, including where new information indicates fraud, material misrepresentation, unlawful activity, security risk or another material breach of this Policy.

The Company is not required to disclose confidential security controls, fraud-detection methods, internal risk criteria or other information where disclosure could reasonably compromise Platform security, compliance procedures, fraud prevention or the rights of other persons, except where disclosure is required by Applicable Laws.

Where required or permitted by law, the Company may preserve relevant records and disclose information to competent authorities, payment service providers or other authorised recipients where reasonably necessary to investigate suspected unlawful activity, protect legal rights or comply with legal obligations. Any processing of personal data for these purposes is subject to the Privacy Policy and applicable data protection law.

Enforcement action under this Policy is subject to the Terms & Conditions, including any applicable provisions relating to suspension, termination, complaints, refunds and limitations of liability.

9. Recordkeeping and Policy Review

The Company may maintain records relating to the application and enforcement of this Policy where reasonably necessary for Platform administration, fraud prevention, security, compliance, dispute resolution or the establishment, exercise or defence of legal claims.

Such records may include relevant User information, Project information, communications, compliance-related correspondence and records of decisions or measures taken under this Policy.

Personal data contained in such records will be processed and retained in accordance with the Privacy Policy and applicable data protection law. The Company does not retain records under this Policy for longer than reasonably necessary for the relevant purpose, subject to any legal or regulatory retention requirements.

Access to such records is limited to persons and service providers who require access for legitimate Platform-related purposes and is subject to appropriate technical, organisational and confidentiality safeguards.

The Company may review and update this Policy and related internal procedures from time to time to reflect changes in Platform functionality, applicable legal requirements, security considerations or compliance risks. Such internal review does not constitute regulatory approval, certification or external verification of the Platforms or Services.

10. Changes to This Policy

The Company may update this Acceptable Use Policy from time to time. The current version and its effective date will be published on the relevant Website. Where required by applicable law or where a change materially affects Users' rights or obligations, the Company may provide additional notice in accordance with the Terms & Conditions.
